Terms of Service

1. Agreement to Terms

By accessing or using Orchestria ("the Service"), operated by Morena Capital s.r.o., a company registered in the Slovak Republic ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Orchestria is an AI-first project management platform currently in public beta. The Service allows users to define tasks, connect AI workers (via their own API keys), and manage autonomous task execution. Features, availability, and pricing may change during the beta period.

3. Beta Program

The Service is provided as a beta release. This means:

• Features may be added, modified, or removed without prior notice
• The Service may experience downtime or interruptions
• Data stored during the beta period may not be preserved after general availability
• We actively collect feedback from beta users to improve the platform

4. User Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to use the Service. One person or entity may not maintain more than one free account.

5. API Keys & Third-Party Services

Orchestria supports "Bring Your Own Key" (BYOK) for AI providers including Anthropic, OpenAI, Google, and Moonshot. You are solely responsible for your API keys, their usage, and any costs incurred through third-party AI providers. We encrypt stored credentials using AES-256 but do not accept liability for third-party service outages or billing.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service infrastructure
• Use the Service to generate harmful, abusive, or illegal content via AI workers
• Reverse engineer, decompile, or disassemble any part of the Service
• Resell access to the Service without our written permission

7. Intellectual Property

You retain ownership of all content and data you create using the Service. We retain ownership of the Service itself, including its design, code, and branding. AI-generated outputs produced by your workers using your API keys belong to you, subject to the respective AI provider's terms.

8. Payment & Billing

Free tier users are not charged. Paid plans are billed monthly via Stripe. All fees are non-refundable except where required by law. We reserve the right to change pricing with 30 days' notice to existing subscribers.

9. Limitation of Liability

To the maximum extent permitted by law, Morena Capital s.r.o. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time through the Settings page. Upon termination, your right to use the Service ceases immediately. We may retain anonymized usage data for analytics purposes.

11. Governing Law

These Terms are governed by the laws of the Slovak Republic. Any disputes shall be resolved in the competent courts of Bratislava, Slovak Republic.
